01When does a signboard require a Buildings Department submission or prior approval?

Erecting or altering an advertising signboard is building work controlled under the Buildings Ordinance, but the required route is not the same for every sign. Depending on its size, location, projection, structure, and installation method, the work may be a Designated Exempted Work, Minor Work, or general building work requiring prior approval of plans and consent to commence. We first inspect and classify the proposal, then arrange the professionals or registered contractors qualified for the relevant class and type.

02What should I do after receiving a Buildings Department removal order?

First confirm the signboard covered by the order and the compliance deadline, then promptly appoint a suitably qualified professional or registered contractor to assess and safely remove it. The required records and follow-up should then be submitted to the Buildings Department. Failure to comply without reasonable excuse can, on conviction, result in imprisonment for up to one year and a fine of HK$200,000, plus a further daily fine of HK$20,000 while non-compliance continues.

03How long does a signboard submission under the Minor Works Control System take?

Timing depends on the class of works and the complexity of the site survey, drawings, and structural documents. For Class I and II minor works, a notice must be submitted at least seven days before commencement and completion documents within 14 days after completion. Class III minor works generally do not require a pre-commencement notice, but completion documents remain due within 14 days. For the erection of a Class III signboard, the contractor may also request a displayable submission number in advance using Form MW32.

04Is a submitted signboard permanently valid, or must every signboard be inspected every five years?

The five-year validation cycle does not apply to every signboard completed through the normal approval or minor works procedures. It specifically applies to eligible existing unauthorised signboards acknowledged under the Buildings Department’s Signboard Validation Scheme. At the end of each five-year period, the owner must make a fresh validation submission or remove the signboard. All owners should nevertheless maintain their signs in a structurally safe condition and comply with any project-specific requirements.
